Welcome to Dayo. These Terms of Service (“Terms”) govern your use of the Dayo mobile application (“the app”) developed and published by Nova Nomads LLC (“we,” “us,” or “our”). By downloading, installing, or using Dayo, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Dayo, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you do not agree, you must not use the app.

2. Description of Service

Dayo is a daily affirmation and personal reflection app. The app provides:

Daily curated affirmations across multiple categories.
A personal journal for saving and writing reflections.
Preference-based affirmation personalization.
Customizable notification reminders.
Reflection tracking and streak features.

3. User Accounts

Dayo does not require you to create an account or provide any personal credentials. Any information you provide (such as your display name) is stored locally and is not transmitted to us.

4. Free and Premium Tiers

4.1 Free Tier

Dayo is free to download and use. Free users are subject to:

Advertisements displayed via Google AdMob (banner, interstitial, and rewarded ads).
A monthly limit of 3 journal entries per calendar month.

4.2 Dayo Premium

Dayo Premium is available as a one-time in-app purchase. Premium users receive:

Complete removal of all advertisements.
Unlimited journal entries.
Access to all current and future premium features.

5. In-App Purchases and Payments

All in-app purchases are processed by Apple through the App Store. We do not directly handle any payment information.
Dayo Premium is a non-consumable, one-time purchase tied to your Apple ID and can be restored on any device signed into the same Apple ID.
Refund requests must be directed to Apple at reportaproblem.apple.com.

6. Advertisements

Free-tier users will see advertisements served by Google AdMob. Ads may include banner, interstitial (limited to once per day), and optional rewarded ads. There is a 3-day grace period after installation during which no ads are shown. You may remove all advertisements by purchasing Dayo Premium.

7. User Content

Any content you create within Dayo remains entirely yours. We do not claim any ownership, license, or rights to your content. All user-generated content is stored locally on your device and is never uploaded to any server. You are solely responsible for the content you create.

8. Intellectual Property

The Dayo app, including its design, affirmation content, graphics, icons, and code, is the intellectual property of Nova Nomads LLC. You may not:

Copy, modify, or distribute the app or its content.
Reverse-engineer, decompile, or disassemble the app.
Use the app’s content for commercial purposes without written permission.
Remove or alter any proprietary notices in the app.

9. Disclaimer of Warranties

Dayo is provided on an “as is” and “as available” basis without warranties of any kind. Important: The affirmations and content provided by Dayo are intended for general wellness and motivational purposes only. They do not constitute medical advice, psychological counseling, or therapy. If you are experiencing mental health issues, please consult a qualified healthcare professional.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Nova Nomads LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the app. Since all data is stored locally, we are not responsible for data loss resulting from device failure, app deletion, or operating system issues.

11. Location Services

Dayo may request access to your device location (entirely optional). Location data is processed locally on your device.

12. Notifications

Dayo may request permission to send local push notifications. All notifications are scheduled locally on your device. You can manage notification preferences within the app’s settings at any time.

13. Termination

You may stop using Dayo at any time by deleting the app. Upon deletion, all locally stored data is permanently removed. We reserve the right to discontinue the app or any features at any time.

14. Changes to These Terms

We may update these Terms from time to time. Your continued use of the app after any changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by applicable law. Any disputes arising from these Terms or your use of the app shall be resolved in the appropriate courts of competent jurisdiction.

16. Privacy

Your use of Dayo is also governed by our Privacy Policy. Please review it carefully.

17. Language and Translation Disclaimer

Dayo and all related materials — including the app, website, affirmation content, legal documents, and any other written materials — are originally written in English. Translations into other languages are provided for convenience only.

In the event of any inconsistency, ambiguity, or conflict between the English version and any translated version, the English version shall prevail and be considered the authoritative, legally binding version.

Nova Nomads LLC makes no representations or warranties regarding the accuracy, completeness, or quality of any translation. Translations may be generated with the assistance of automated tools and may not perfectly reflect the original meaning. We expressly disclaim any liability arising from errors, omissions, misunderstandings, or reliance on any translated content. Use of translated content is entirely at your own risk.
